Morality is a normative system of guidance that figures into practical reason by telling people what to do in various situations. The problem, however, is that morality has inherent gaps that often render it inefficacious. First, it may be indeterminate due to the high level of generality in which its principles are formulated. Second, moral terms such as ‘good’ and ‘right’ may be so vague that they fail to specify the requisite behavior. And third, its subjective aspect, which is a (...) product of personal experience, generates moral disagreement and thereby creates coordination problems that frustrate society’s collective moral aims. The objective of this article is to advance the thesis that morality must sometimes depend on law as a supplementary source of practical reason, a dependence which can be explained in terms of three essential features of law: its institutional character, its claim to authority, and its status as a second-order exclusionary reason for action. It shall then be explained how these three features enable law to make difficult decisions on behalf of individuals, define objective standards of conduct, and solve coordination problems, respectively, and in doing so, manage to fill in the gaps of morality mentioned above. Hence, it will be argued that law is also a normative system that helps people achieve their moral aims, notwithstanding the fact that it guides human behavior through a different logic and mode of operation from those of morality. Si se consideran como di††hi, las preguntas sin declarar son simplemente un conjunto de proposiciones conceptualmente distorsionadas. El trabajo se ha dividido en cinco secciones. En las dos primeras se presenta la explicación del Buddha de su propio silencio. Tienen un alcance meramente expositivo con el objeto de situar la discusión en los términos en que fue originariamente planteada. La tercera (...) parte explica los mecanismos mentales que intervienen en la generación mental de patrones mentales distorsionados. El papel que desempeña papañca en el desarrollo de las tendencias subyacentes y la aparición de efluvios mentales se ha desarrollado en la cuarta parte. El presente artículo plantea, partiendo de las vivencias de padres oyentes ante la llegada de un hijo sordo a partir de sus narraciones y experiencias de vida, por un lado, la comprensión de las etapas por las que atraviesan desde el momento en que se sospecha la existencia de la discapacidad de su hijo, hasta el momento en que es confirmada y asumida; por otro lado, describir los cambios que se producen al interior de la dinámica familiar ante la llegada (...) de un hijo en situación de discapacidad auditiva. En este trabajo sobre las reflexiones del escritor vasco en torno a la muerte me ceñiré a aquellas obras de carácter filosófico en las que el tema es tratado con cierto detenimiento. Si bien es verdad que en los primeros escritos hace alguna mención breve a esta cuestión, donde propiamente la desarrolla con mayor esmero y originalidad es en cinco obras, de las que ofreceré una síntesis de las ideas más relevantes, con alguna que otra concisa crítica, a fin de (...) no superar la extensión concedida. He aquí las obras principales en las que se pronuncia sobre la muerte: Política para Amador (PA), Diccionario filosófico (DF), Despierta y lee (DL), Las preguntas de la vida (PV) y La vida eterna (VE). Leídas globalmente se pueden extraer diversos temas entremezclados, algunos tratados por clásicos filósofos, otros no. Por una mayor claridad serán aquí diferenciados y ordenados con el propósito de que resulte la presentación de esta dimensión de la ética savateriana más coherente y didáctica. (shrink)

En el artículo se presenta una descripción de la crítica a la modernidad demostrada por el filósofo argentino Enrique Dussel señalando el proceso mediante el cual se fue configurando como un proyecto europeo. En efecto, el artículo plantea que dicho proyecto se postula en el marco de una centralidad que iría a justificar las prácticas coloniales implementadas. Para lograr mantenerse dentro de la dinámica histórica, estos hábitos empezaron a circunscribirse en discursos míticos so pretexto de justificar la violencia efectuada (...) en las prácticas. Dussel, por su parte, propone la categoría de Transmodernidad como proyecto alternativo emergente a la modernidad europea. No obstante, esta propuesta es objeto de críticas como las del filósofo colombiano Santiago Castro-Gómez. (shrink)

A crise dos modelos de representação fundadas em unidades coerentes e ordenadas parece ter como um dos traços o que Bruno Latour (1993) chamou de “híbridos”(1). Os híbridos são a figura da multiplicidade que não cabe em categorias e que a modernidade “varia para baixo do tapete”. Atualmente, assistimos ao “retorno dos que nunca foram”, que interpelam de forma contundente nossas formas de vida, fortemente apoiadas na técnica. Mas como apreender os fluxos de discursos e práticas mediatizadas que nos atravessam (...) sem cair nas armadilhas do tecnicismo? Que configurações poderiam hoje assumir práticas e discursos críticos? Que agenciamentos propor? Tentar compreender o estatuto do tecnológico, do político, do artístico, do urbano e do banal como “artes do fazer” parece-nos uma tarefa urgente e necessária. Gilles Deleuze (1977), em “Kafka, por uma literatura menor” (2), deixa-nos uma importante pista, ao afirmar, em sua definição de agenciamento, que “a técnica é antes de tudo social”. A direção nos permite avançar para além das concepções instrumentalistas e dicotômicas da técnica e percebê-la enquanto processo complexo de mediação. De fato, como também afirmava Simondon (1989), os objetos técnicos sempre foram gerados por mediação e geradores de mediação(4). O presente número da Revista Logos traz justamente contribuições para fomentar esse debate e para compor o já vasto quadro das cartografias sobre tecnologia e sociabilidade no Brasil, no campo das possibilidades de mediação sociotécnica. Trata-se de um número especial, organizado dentro da parceria PPGC-Uerj e Centre d’Etudes sur l”Actuel et lê Quotidien (CEAQ) - Paris V, com a colaboração do Professor Stéphane Hugon, coordenador do GRETECH, grupo de pesquisa sobre Tecnologia e Quotidiano. Se, por um lado, o conjunto de artigos compartilha determinados referenciais teóricos, por outro, acolhe também visões próprias, forjadas a partir de diferentes experiências sociais e em distintos contextos culturais. Em comum, todos partem de certa forma da percepção de que as mediações presentes nos processos de sociabilidade podem colaborar nos processos de negociação com as regras e códigos sociais vigentes para inventar outros possíveis. Todos, de certa forma, dão a ver, em seu conjunto, que entramos numa arena onde os diversos elementos que constituem o social interagem e ganham novos contornos: o político não dialoga apenas com o “ideológico”, mas também com o cultural, o subjetivo, o artístico. Da mesma forma, a arte, por exemplo, não diz respeito apenas ao cânone, mas também ao político, ao urbano, ao sensual e ao banal. Com isso, também a noção de tecnologia se amplia e, entendida como “máquina social”, pode ajudar-nos a melhor apreender as dimensões dos fenômenos culturais e de comunicação hoje. Finalmente, Hedi Zamouri faz uma etnografia da Brigada Anti-Pub, movimento contra o abuso da publicidade nos espaços públicos de Paris e José Cláudio Castanheira resenha o último livro de Shetyl Turkle, “História íntima dos objetos”. The opposition prose/verse can only be established in the heart of literal language. The only way of producing nonliteral language is in conversation. . . . Enrique Anderson Imbert published a book in 1958 titled ¿Qué es la prosa? , in which he says: 'No, we do not speak in prose. Prose is not a projection of everyday speech, but rather artistic elaboration."1 But my adherence to his intelligent point of view is not total because he situates prose in (...) the heart of written language, and I think that it should be ascribed to literal language. For Anderson Imbert such an idiomatic modality results in an artistic elaboration; but the intention of prose can be quite different. The reader, for instance, by virtue of his reading, can transform prose into literature; and unwritten prose does exist, as has been stated. In many cases it is impossible to compose the texts in verse; structurally, then, an opposition cannot be established, just as in the case of the student who takes notes following the explanations of the professor. Frank Wilderson: I introduce a semiotic configuration. The point is, at important levels of abstraction, people who are positioned as Black—which is very different from saying people who think of themselves as Black. One of the basic premises of Afropessimism, which makes it resonate with psychoanalysis or Marxism, is that where one is positioned in a paradigm might not be where one thinks one is or where one desires to be. When I teach undergraduates, I say: “Look, I used to (...) study neorealism. In these neorealist films, we have these people who are bona fide fascists, and then you have those people in the Communist Party, so they could not agree on much. They don’t see themselves as having much of a connection. But in a Gramscian sense, they are both positioned as the host of capitalist parasites. Both groups rely on the wage. So, they are both workers.” One of the big points with respect to the narratological question is that I, as a Black person, trained at Columbia University in creative writing, trained at UC Berkeley in critical theory, love narrative, but narrative does not love me. In other words, it is impossible for me to be “emplotted” as a speaking subject. I can only be “emplotted” as an object of narrative. But I am always struggling to attain that love of humanity; and if I were to attain it, the Human would not have a foil against which to know itself. So, what I am saying is that in a book like Red, White & Black, I am just being very categorically clear about the divisions. In Afropessimism, I am actually talking about the desire of a sentient being who cannot be allowed into an arena where people are recognized and incorporated, in Lacanian terms, as “contemporaries” of human beings. So, there is all this back and forth. I don’t think this speaking subject in Afropessimism ever achieves anything in particular. It is always struggling toward being a subject that can actually travel on a narrative arc and yet ultimately is an object that can never travel from dispossession to redemptive recovery. (shrink)

In recent years, the term populism has become indeed popular. Among its variants, a very particular one stands out. It is the so-called managerial populism, in which prominent businessmen have entered the arena of politics with a program focused on the regeneration of economic and social life. Donald Trump, perhaps, has been the most outstanding example. In this article, our aim is to analyze this phenomenon of managerial populism, addressing a number of issues. Firstly, we will discuss the emergence of (...) a certain type of charismatic leadership in business or management ideologies as a development that largely precedes the consolidation of these figures in the political scene; the implications of these ideologies in the political and social sphere; and the importance of the forms of discursive use of the concept of people in these popular discourses. In this essay I pay homage to one of the most important but neglected philosophers of liberation in Latin America, Luis Villoro, by considering what possible lessons we can learn from his philosophy about how to approach injustices in the Americas. Villoro was sympathetic to liberatory-leftist philosophies but he became concerned with the direction they took once they grew into philosophical movements centered on shared beliefs or on totalizing theories that presume global explanatory power. These movements became vulnerable to extremes (...) or vices that undermine their liberatory promise. I examine some of these worrying tendencies among that body of literature roughly described as “decolonial thought” (e.g., Enrique Dussel, Walter Mignolo). After a concise presentation of Villoro and the decolonial turn, I consider four dangers that this new liberatory-leftist movement faces and why Villoro should be a significant voice as the decoloniality debate moves forward. En este artículo nos disponemos desarrollar la tesis según la cual la crítica elaborada por Santiago Castro-Gómez a Enrique Dussel se trató de una desnaturalización del análisis del filósofo argentino sobre el proyecto moderno, en la cual Castro-Gómez puso de relieve las prácticas de las herencias coloniales como condición de posibilidad para la emergencia de la modernidad, sin necesidad de recurrir a la figura fundante del sujeto, aspecto que sí se encuentra presente en la propuesta del mendocino. Esta tesis (...) se demostrará mediante un diálogo crítico entre estos dos autores en torno al problema de la modernidad y la colonialidad a partir de tres claves analíticas, la posmodernidad, la modernidad y la descolonización, con el fin de pensar el modo en que las prácticas coloniales operaron en el proyecto moderno a través del uso de los valores presentes en la misma modernidad, sin que ello implique caer en una supuesta desmodernización. Es una coyuntura caracterizada por un vacío de poder en las colonias debido a la abdicación y posterior arresto del rey Fernando VII. We used 7,415 advertisements published in Spain to analyze traits sought/offered by men and women from different age groups. Findings regarding age, socioeconomic status, and physical attractiveness requirements support evolutionary predictions about mate preferences. However, changes in trait preferences among women under 40 appear to be contingent on Spain’s socioeconomic transformation. Women under 40 seek mainly physical attractiveness in men, whereas those over 40 seek mainly socioeconomic status. The trait most sought by men in all age groups is physical attractiveness. (...) Traits sought and offered by advertisers may be conditioned by the personal situation of the advertiser. Mean age of advertisers (around their forties) and Spain’s social indicators suggest that the majority of advertisers have been unsuccessful in the mating arena at the conventional age. (shrink)

ABSTRACTThis article studies multi-stakeholder initiatives as spaces for both deliberation and contestation between constituencies with competing discourses and disputed values, beliefs, and preferences. We review different theoretical perspectives on MSIs, which see them mainly as spaces to find solutions to market problems, as spaces of conflict and bargaining, or as spaces of consensus. In contrast, we build on a contestatory deliberative perspective, which gives equal value to both contestation and consensus. We identify four types of internal contestation which can be (...) present in MSIs—procedural, inclusiveness, epistemic, and ultimate-goal—and argue that embracing contestation and engaging in ongoing revision of provisional agreements, criteria, and goals can enhance the democratic quality of MSIs. Finally, we explore the implications of this perspective for theorizing about the democratic quality in MSIs and about the role of corporations in transnational governance. (shrink)

Abstract The article addresses three aspects of the humanitarian intervention doctrine. It argues, first, that the value of sovereignty rests on the justified social processes of the target state ? the horizontal contract. Foreign interventions, even when otherwise justified, must respect the horizontal contract. In contrast, morally objectionable social processes (such as the subjection of women) are not protected by sovereignty (intervention, of course, may be banned for other reasons). In addition, tyrants have no moral protection against interventions directed at (...) them. Second, the article addresses the internal legitimacy of humanitarian intervention. It concludes that the liberal state may only use voluntary soldiers (either the voluntary army or mercenaries) to conduct humanitarian intervention. Conscription for that purpose is not permissible. The article shows that the long-standing criticism of mercenaries stems from a romantic prejudice and is thus unfair. Third, the article makes a distinction between intention (the determination to perform an action) and motive (a further goal that the agent seeks with that action) and shows that only intention is relevant for humanitarian intervention. A justified humanitarian intervention requires the intention to liberate the victims, but not necessarily a good further motive. It shows how mainstream doctrine has impermissibly confused the two concepts. (shrink)

The aim of this paper is to explore the peculiar case of infectious logics, a group of systems obtained generalizing the semantic behavior characteristic of the -fragment of the logics of nonsense, such as the ones due to Bochvar and Halldén, among others. Here, we extend these logics with classical negations, and we furthermore show that some of these extended systems can be properly regarded as logics of formal inconsistency and logics of formal undeterminedness.

It has been known for six years that the restriction of Girard's polymorphic system $\text{\bfseries\upshape F}$ to atomic universal instantiations interprets the full fragment of the intuitionistic propositional calculus. We firstly observe that Tait's method of “convertibility” applies quite naturally to the proof of strong normalization of the restricted Girard system. We then show that each $\beta$-reduction step of the full intuitionistic propositional calculus translates into one or more $\beta\eta$-reduction steps in the restricted Girard system. As a consequence, we obtain (...) a novel and perspicuous proof of the strong normalization property for the full intuitionistic propositional calculus. It is noticed that this novel proof bestows a crucial role to $\eta$-conversions. (shrink)

En el terreno de la moral, el contraste entre lo ¿que el filósofo Wilfrid Sellars denominó «la ¿imagen manifiesta» y la «imagen científica» es enorme y tiene unas consecuencias prácticas ineludibles. Este libro reduce la distancia entre esa imagen manifiesta y la imagen científica, dotando al lector de referencias fundamentales, enfoques diversos y un amplio abanico de temáticas a partir de investigaciones experimentales sobre nuestra conducta moral.

In this article, we suggest that one of the unexplored paths toward collaboration between firms and civil society organizations starts with confrontation or potential conflict, and that the transition toward collaboration can be further understood if one focuses on triadic relationships rather than dyadic ones. We analyze the presence of third parties and their different roles to explain how collaboration is facilitated. The article aims at bringing together the bodies of research on business–civil society confrontation and on business–civil society collaboration. (...) It offers a comparative analysis of four case studies, and proposes a typology of third parties composed of facilitating allies, participating allies, mediators, and solution seekers. We introduce a herbrandized functional interpretation of a first-order semi-intuitionistic extension of Heyting Arithmetic and study its main properties. We then extend the interpretation to a certain system of second-order arithmetic which includes a (classically false) formulation of the FAN principle and weak König's lemma. It is shown that any first-order formula provable in this system is classically true. It is perhaps worthy of note that, in our interpretation, second-order variables are interpreted by finite sets of natural numbers.

Both questions as abstract objects and the speech acts, here called requests, by which we ask them play an enormous role in all argumentative practices. Nonetheless, there is hardly a proper systematic treatment of questions and requests in current argumentation theories. This paper is a first attempt at providing such a systematic treatment. This is achieved by following the ideal model of a critical discussion as elaborated over the years by the Amsterdam school of pragma-dialectics. After introducing the distinction between (...) questions and requests, the paper sets forth and illustrates the norms of questioning which implicitly underlie the four stages of a critical discussion in the standard order: confrontation, opening, argumentation, and conclusion. Among other things, it is shown that crucial insights of pragma-dialectics are illuminated by the questioning perspective, in particular the distinction between single and multiple differences of opinion, the duties of the antagonist and protagonist roles, the precise character of the argumentation stage, and the different ways in which a disagreement can be resolved. This paper explores the role of NGOs in corporate social responsibility (CSR) through an analysis of various stakeholders’ perceptions and of NGOs’ self-perceptions. In the course of qualitative research based in Spain, we found that the perceptions of the role of NGOs fall into four categories: recognition of NGOs as drivers of CSR; concerns about their legitimacy; difficulties in the mutual understanding between NGOs and trade unions; the self-confidence of NGOs as important players in CSR. Each of these categories comprises (...) the various elements analysed in the paper. We found some discrepancies between the perception of others and the self-perceptions of NGOs, which explains why their role is often controversial. The research confirms that secondary stakeholders, such as NGOs, are key players in CSR, but their role is still regarded as controversial and their legitimacy contested. Deep-seated misunderstandings and mistrust among various stakeholder groups (particularly between NGOs and trade unions) are a possible hurdle to the integration of social and environmental concerns in business activity and corporate governance in Spain. The study finds that business managers need to take a less firm-centric and a more contextual approach, and look more closely into the relationship with and among stakeholder groups. For NGO managers, the research shows that NGOs are not always aware of the stereotypes they generate and the problems caused mainly by what is seen as ambivalent roles: critic and counsellor, accuser and judge, idealist and fund raiser.
